These terms and conditions (the “Terms and Conditions”) govern the use of WhatAboutThe.com (the “Site”). This Site is owned and operated by WhatAboutThe LTD c/o Holy Scratchimony. This Site is a creative agency; handling Graphic / Web Design, as well as DJ bookings, Music equipment rental, Music production and consultation.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of WhatAboutThe LTD and the Site’s creators, unless stated and / or labelled otherwise. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Limitation of Liability
WhatAboutThe LTD and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless WhatAboutThe LTD and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the Country of England.

Additional Terms

– WhatAboutThe… Design?
We’ll design and create layouts and assets for the branding and functionality of the site / document(s) we build for you. After consultation, we will create two initial design drafts for you to choose from. From here, and if necessary, you will be able to amend factors of / designs twice. If, after any amends, you are not happy with the work – you are entitled to cancel our contract and obliged to pay the total amount of any / all work that we have produced. Alternatively, you can continue to make further design revisions, or re-designs, at our daily rate of £300 (inc. VAT) unless specified / agreed otherwise.

Any / all Graphic or Web Design work are kept in individual, secure client files and have the original proposed quote honoured for 12 months from agreement / work commencing. It is the client’s responsibility to ensure any / all necessary information, copy and / or content is provided within this timeframe. Failure to do so will lead to WhatAboutThe LTD issuing a revised quote in order to finish the work. Alternatively, WhatAboutThe LTD reserves the right to cancel projects without reimbursement of prior down payments and / or deposits, should client delays surpass 12 months. WhatAboutThe LTD reserves the right to issue late payment invoices for finished projects that haven’t been paid in accordance to the terms stated on our invoice.

– WhatAboutThe… Hospitality DJs?
After initial conversation and agreement, and only in the event of your venue requiring extra / additional support in hosting DJs, we offer comprehensive consultancy with regards to specifying and sourcing equipment. This is charged at £180 per day; based on one initial appointment, following with the time it takes to liaise / purchase / deliver with third parties in order to obtain equipment.

We ask for monthly payments for DJ rosters to be made in advance of any / all performances. However, we are open to advance weekly “rolling” payments.

In return, we will organise a roster of DJs, suited and briefed for your venue – including cover DJs to cover any absentees. If for any reason we are unable to provide a DJ due to unforeseen circumstances; you will be reimbursed for that night’s performance fee. Similarly, if you / the venue cancel a booking, the following refund policy will apply:

  • Cancellation more than 4 weeks before the DJ booking: 50% of the total fee will be refunded.

  • Cancellation between 2 to 4 weeks before the DJ booking: 30% of the total fee will be refunded.

  • Cancellation between 1 to 2 weeks before the DJ booking: 20% of the total fee will be refunded.

  • Cancellation less than 1 week before the DJ booking: No refund will be issued.

– WhatAboutThe… Additional Services?

We offer additional services, including curated playlists, asset creation and social media posts for your venue. Social assets will be treated as a design brief (please see Design terms) with a reduced day rate of £180. Playlists will be reviewed / revised quarterly, throughout the year. After 12 months, new playlists will be created for the existing fee, or the existing playlists will be deleted, should your venue no longer require the service.

– WhatAboutThe… Private DJs?

1. Overview
These Terms and Conditions (“Terms”) govern the booking of DJ services for weddings provided by WhatAboutThe LTD c/o Holy Scratchimony (“Company”). By booking our services, you (“Client”) agree to be bound by these Terms.

2. Booking and Payment
2.1 A non-refundable deposit of 20% of the total fee is required to secure the booking. 2.2 The remaining balance is due 24 hours before the wedding date.

3. Cancellation Policy
3.1 If the Client cancels the booking, the following refund policy will apply:

  • Cancellation more than 4 months before the wedding date: 50% of the total fee will be refunded.

  • Cancellation between 2 to 4 months before the wedding date: 30% of the total fee will be refunded.

  • Cancellation between 1 to 2 months before the wedding date: 20% of the total fee will be refunded.

  • Cancellation less than 1 month before the wedding date: No refund will be issued.

4. Rescheduling
4.1 If the Client wishes to reschedule the booking, the Company will make reasonable efforts to accommodate the new date, subject to availability. 4.2 A rescheduling fee may apply.

5. Force Majeure
5.1 The Company is not liable for any failure to perform its obligations if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, government regulations, or other emergencies.

6. Limitation of Liability
6.1 The Company’s liability for any claim arising out of these Terms shall not exceed the amount paid by the Client for the services.

7. Governing Law
7.1 These Terms shall be governed by and construed in accordance with UK laws.

8. Entire Agreement
8.1 These Terms constitute the entire agreement between the Client and the Company and supersede all prior understandings and agreements, whether written or oral.

9. Amendments
9.1 The Company reserves the right to amend these Terms at any time. Any such amendments will be communicated to the Client in writing.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our business.
