Terms & Conditions

These Terms & Conditions (“Terms”) govern all services provided by WhatAboutThe LTD, including design, music, and consultancy work. By commissioning any services or using this website (whataboutthe.com), you agree to these Terms.


1. Services Overview

WhatAboutThe LTD is a creative agency offering:

  • Graphic Design & Web Development

  • DJ Bookings (hospitality + private events)

  • Music Consultancy & Equipment Sourcing

  • Music Production & Playlist Services


2. Intellectual Property

2.1 Site Content

All content on this site, unless otherwise stated, is the intellectual property of WhatAboutThe LTD.

2.2 Client Projects

Unless otherwise agreed:

  • Designs (e.g. logos, branding, websites) remain the intellectual property of WhatAboutThe LTD until full payment is received.

  • Upon full payment, the client is granted a non-exclusive, non-transferable license to use the final designs for agreed-upon purposes.

  • WhatAboutThe LTD reserves the right to display work in portfolios or promotional materials.

  • Working files (e.g. .ai, .psd, Sketch, Figma) remain the property of WhatAboutThe LTD unless explicitly included in the project scope.


3. Design & Web Projects

3.1 Quotes & Project Scope

  • All project quotes are valid for 3 months from issue.

  • Clients are responsible for providing timely content and access to required assets.

  • If delays exceed 3 months, WhatAboutThe LTD reserves the right to re-quote or cancel the project.

3.2 Project Commencement & Payment Terms

  • A 50% non-refundable deposit is required to begin work.

  • Written confirmation (via email or message) of intent to proceed constitutes acceptance of terms.

  • Remaining 50% is due upon project completion, before final deliverables are handed over.

  • If the deposit is not paid within 7 days of confirmation, the project may be cancelled or rescheduled.

3.3 Revisions & Amends

Project estimates allow for a standard number of revisions. Any additional work outside the agreed scope will be quoted and billed separately.


Website Hosting & Maintenance

4.1 Hosting Services

WhatAboutThe LTD may provide website hosting, maintenance, backups, security monitoring, software updates, performance optimisation, and related services as agreed with the Client.

Hosting and maintenance services are provided on an annual recurring basis unless otherwise agreed in writing.

4.2 Renewal & Payment

Hosting and maintenance fees are payable in advance.

Renewal invoices will be issued prior to the renewal date.

Failure to pay by the renewal date may result in the suspension or termination of hosting, maintenance, backups, email services, and related website functionality.

WhatAboutThe LTD shall not be liable for any loss arising from suspension or termination due to non-payment.

4.3 Support Allowance

Where a hosting or maintenance package includes support time, such support is limited to the amount specified within the relevant package.

Unused support time does not roll over between months.

Work exceeding the included allowance, or work falling outside the agreed scope of support, may be quoted and billed separately at the prevailing rate.

4.4 Third-Party Services

Websites may rely on third-party providers and services including hosting companies, domain registrars, payment gateways, plugins, themes, analytics providers, search engines, email providers, and cloud infrastructure services.

WhatAboutThe LTD cannot guarantee the availability, performance, or continued operation of any third-party service and shall not be liable for interruptions, changes, outages, security incidents, service discontinuation, or loss arising from the actions or failures of third-party providers.

4.5 Updates & Compatibility

Reasonable efforts will be made to keep website software, plugins, themes, and related systems updated and secure.

However, WhatAboutThe LTD cannot guarantee that updates, third-party software changes, hosting environment changes, or software conflicts will be free from errors, downtime, or compatibility issues.

Additional development work required to investigate or resolve compatibility issues may be chargeable.

4.6 Backups

Backups may be provided as part of a hosting or maintenance package.

While reasonable efforts are made to maintain backup systems, WhatAboutThe LTD does not warrant that backups will always be available, complete, recoverable, current, or free from corruption.

Clients remain responsible for maintaining copies of any business-critical data, content, or assets.

4.7 Security

WhatAboutThe LTD will implement reasonable security measures appropriate to the hosting package provided.

No website, server, or online service can be guaranteed to be completely secure.

WhatAboutThe LTD shall not be liable for losses arising from hacking, malware, denial-of-service attacks, unauthorised access, data breaches, or other cyber incidents except where caused directly by our negligence.

4.8 Domain Names

Unless expressly agreed otherwise in writing, the Client remains responsible for the registration, renewal, and management of domain names.

WhatAboutThe LTD shall not be liable for any loss arising from domain expiry, suspension, transfer issues, registrar actions, or failure by the Client to maintain an active registration.

4.9 Suspension & Termination

WhatAboutThe LTD reserves the right to suspend or terminate hosting and maintenance services where invoices remain unpaid beyond their due date.

Following termination, website files, databases, email accounts, backups, and related data may be permanently deleted after thirty (30) days unless otherwise agreed in writing.

It is the Client’s responsibility to request and arrange migration of any website, email, or related data before termination takes effect.

4.10 Service Availability

WhatAboutThe LTD does not guarantee uninterrupted availability, uptime, or error-free operation of hosting, maintenance, backup, or related services.

Temporary interruptions may occur due to maintenance, software updates, third-party service failures, security incidents, or circumstances beyond our reasonable control.

Such interruptions shall not constitute a breach of these Terms and shall not entitle the Client to compensation unless otherwise required by law.


5. DJ Bookings – Hospitality

  • DJ rosters are organised on a rolling or monthly basis.

  • Payment is required in advance of scheduled performances.

  • If a DJ cannot attend due to unforeseen circumstances, WhatAboutThe LTD will issue a refund for that date or provide a replacement.

  • In the event of cancellation by the client/venue, the following applies:

5.1 Equipment Sourcing

DJ booth consultancy and equipment sourcing are charged at £250/day, covering site visits, third-party liaising, and procurement.

5.2 Further Services

  • Playlist creation and social media content are treated as separate design jobs and billed at a reduced rate of £250/day.

  • Playlists are reviewed quarterly; after 12 months, a new fee is required or the playlists will be removed.


6. DJ Bookings – Private Events (e.g. Weddings)

6.1 Deposit & Payment Terms

  • A 25% non-refundable deposit is required at booking.
  • For bookings made within four (4) months of the event date, a 50% deposit is required.
  • For bookings made within four (4) months of the event date, 25% of the total booking value (being half of the 50% deposit) is non-refundable in the event of cancellation.
  • The remaining balance is due no later than the agreed date stated in our Proposal.

6.2 Client Cancellations (Weddings)

6.3 Client Responsibility for Guests

The Client is responsible for the conduct of all guests, and invitees, attending the event.

6.4 Abusive, Threatening or Unsafe Behaviour

WhatAboutThe LTD reserves the right to suspend or terminate performance and/or remove equipment without refund where any member of our team is subjected to physical violence, threats of violence, harassment, intimidation, discriminatory conduct, or persistent abusive behaviour by the Client, or guests.

Where reasonably possible, a warning may be issued and the Client given an opportunity to resolve the situation. However, WhatAboutThe LTD may act immediately where the safety or wellbeing of staff is at risk.

6.5 Protection of Equipment & Working Environment

WhatAboutThe LTD reserves the right to reposition, isolate, or temporarily cease use of equipment where guests interfere with, tamper with, climb on, spill liquids onto, or otherwise create a risk of damage to equipment or injury to persons.

Any resulting interruption shall not constitute a breach of contract and shall not entitle the Client to a refund or compensation.

6.6 Damage to Equipment

The Client shall be liable for the cost of repair or replacement of any equipment owned, supplied, or hired by WhatAboutThe LTD that is lost, stolen, or damaged during the event, where caused by the Client, their guests, contractors, or attendees.

Costs will be based on reasonable repair or replacement with equivalent equipment.

Payment for damages is due within 14 days of written notification.

6.7 Use of Artwork and Likeness (Marketing & Portfolio Rights)

Any artwork, designs, imagery, or creative outputs produced by WhatAboutThe LTD / Holy Scratchimony for the Client in connection with a wedding or private event may be used for portfolio, promotional, and marketing purposes. This includes, but is not limited to, use on websites, social media, printed materials, and case studies.

This may include imagery featuring the Client, their guests, or identifiable likenesses captured or incorporated as part of the commissioned work.

WhatAboutThe LTD will use such material in a respectful and appropriate manner and will not use content in a way that is defamatory, misleading, or intended to cause harm or embarrassment.

If the Client wishes to opt out of such usage, this must be requested in writing prior to the event date and agreed in writing by WhatAboutThe LTD.


7. Equipment Hire

  1. Scope
    WhatAboutThe LTD may, from time to time, provide temporary rental of sound equipment—such as microphones, mixers, loudspeakers, and related accessories—for events (the “Equipment”).

  2. Acceptance of Terms
    By accepting a quote, submitting payment, or taking possession of the Equipment, the “Hirer” agrees to be bound by these Equipment Rental terms, which are supplementary to the general Terms & Conditions.

  3. Use and Care

    • The Hirer is responsible for safeguarding the Equipment from delivery or collection until its return.

    • Equipment must only be used for its intended purpose and by persons who are suitably competent.

    • The Hirer shall inspect the Equipment upon receipt and promptly notify WhatAboutThe LTD of any defects.

  4. Liability for Damage or Loss
    The Hirer is responsible for costs to repair or replace any Equipment that is lost, stolen, or damaged—for whatever reason—except where such loss or damage is caused by the negligence of WhatAboutThe LTD.

  5. Insurance Disclosure
    WhatAboutThe LTD maintains £5 million public liability insurance to cover incidents arising solely from its negligence. This insurance does not cover loss, damage, or injury resulting from the Hirer’s misuse or negligence.

  6. Liability Limitation
    To the extent permitted by law, WhatAboutThe LTD shall not be held liable for any injury, loss, or damage arising out of the Hirer’s use or misuse of the Equipment.

  7. Cancellation
    Cancellations made within 3 days before the event may incur a cancellation fee of 100% of the quoted hire cost.

  8. Governing Law
    This Equipment Rental section is governed by and construed in accordance with the laws of England.

8. Limitation of Liability

WhatAboutThe LTD shall not be held liable for any indirect or consequential loss, including delays due to acts beyond our control (weather, illness, tech failures, etc.).


9. Amendments

These Terms may be updated at any time. Updates will be published on this page.


10. Governing Law

These Terms are governed by the laws of England.
